Trademark

 A trademark is a recognizable sign, design, or expression, which identifies products or services of a particular source from those of others. Although trademarks used to identify services are usually called service marks. The trademark owner can be an individual, business organization, or any legal entity. A trademark may be located on a package, a label, a voucher, or on the product itself. For the sake of corporate identity, trademarks are often displayed on company buildings. It is legally recognized as a type of intellectual property.

Application

 A trademark identifies the brand owner of a particular product or service. Trademark can be used by others under licensing agreements. The unauthorized usage of trademarks by producing and trading counterfeit consumer goods is known as brand piracy.

The owner of a trademark may pursue legal action against trademark infringement. Most countries require formal registration of a trademark as a precondition for pursuing this type of action.

In Pakistan

 In Pakistan, Trademarks Registry (TMR) is the federal government body that governs the rules and procedures for registering the Trademarks for different firms and products. The body works under IPO and acts as a Civil Court, and the head-office for TMR is located in Karachi.

Costs for Trademark-related Procedures and Forms

 A number of different costs are involved in the process of registering, renewing or modifying a trademark. It is the applicant’s responsibility to make sure that all the costs are paid in full at the time of submission of accompanying application form.

Trademarks Ordinance 2001

With the promulgation of Trade Marks Ordinance, 2001, the Trade Marks Registry has acquired a new role of creating mass awareness about the importance of Intellectual Property Rights. In addition to its traditional role of registering trademarks, it has started persuading entrepreneurs to seek protection of their trade and services marks so that they could establish their business on fair practices. In this connection, a separate help line with efficient officials has been maintained at the office of TMR, Karachi, Regional Office, Lahore and IPO-HQs, Islamabad.
